New offer has a joining date? Check the gap & buyout cost
Only if your employer allows it
Gross or basic, whichever your contract says
Pick a resignation date and notice period.
Calendar-day count, the way most Indian employment contracts define notice. Your contract and HR policy are the final word.
The notice period is where job switches quietly fall apart. A new employer wants you in 30 days, your contract says 90, and nobody has worked out the actual date. Getting your last working day right, and knowing whether leave adjustment or a buyout can close the gap, lets you give a joining date you can keep and negotiate the rest before you sign.

How do I calculate my last working day?
Start from the date you formally resign (the date your resignation email or letter is accepted as submitted) and count your notice period in calendar days, weekends and holidays included. If your contract says 60 days and the resignation day counts as day 1, your last working day is 59 days after you resign. If the notice is in months, it usually ends the day before the same date in the final month: resign on 1 October with two months' notice and your last day is 30 November.
Do weekends and public holidays count in the notice period?
In most Indian employment contracts, yes. Notice periods are counted in calendar days, not working days, unless your contract explicitly says working days. Check the exact wording of the notice clause in your appointment letter.
Can I use my leave balance to shorten my notice period?
Sometimes. Many companies let you adjust earned leave against notice, which moves your last working day earlier, but it's at the employer's discretion and some policies pay out unused leave in the full-and-final settlement instead. Ask HR before you count on it.
What is a notice period buyout and how is it calculated?
A buyout means paying your employer for the notice days you don't serve so you can leave early. It's usually calculated as your monthly salary divided by 30, multiplied by the number of days you're short. Contracts differ on whether gross or basic salary is used. Some new employers reimburse the buyout, so ask during the offer negotiation.
Is a 90-day notice period legally enforceable in India?
Notice periods are a contractual term, and courts generally treat a reasonable notice clause you agreed to as binding. What an employer can realistically do if you don't serve it is limited: typically recover pay in lieu of notice from your full-and-final settlement or withhold a relieving letter. Many IT-services companies use 90 days; most startups use 30 to 60. This is general information, not legal advice.
Do companies hire candidates with a long notice period?
Yes, but it narrows your options. Fast-growing startups often need someone within 30 days and may pass on a 90-day notice, while larger companies plan around it. Being clear about your exact last working day, and whether a buyout is possible, makes you easier to hire either way.
